Halliday Fraser Munro win Planning Appeal Challenging Council Policy on Development near Trees

Earlier this month Halliday Fraser Munro’s  Planning Team successfully won a planning appeal on behalf of CALA Homes (North) Limited for additional housing at the leading developer’s Craibstone Estate in the north of Aberdeen. This allows the next phase of CALA homes to proceed at this popular location.  The positive decision by the Reporter appointed by the Scottish Ministers challenges Aberdeen City Council’s restrictive application of their policies and guidance regarding new development next to trees and woodland. This has caused issues on a number of development sites recently. The site at Craibstone has long been allocated for housing in the Local Development Plan with the development concept of housing set within pockets defined by woodland edges. The Reporter did not agree with the Council’s assertion that the houses would be subjected to overshadowing and found that development proposal was entirely acceptable, as argued by Halliday Fraser Munro on behalf of the Appellants.
